EduWork Agency: Service Agreement

 

 

Purpose

This Agreement outlines the terms and conditions under which EduWork Education Agency ("the Agency") will provide advisory and support services to you, the Applicant, for your journey to study in Australia. This Agreement is designed to establish a clear mutual understanding regarding the scope of services, responsibilities, and commercial terms.

Definitions

  • The Agency: Refers to EduWork Education Agency.
  • The Applicant: Refers to the individual engaging the Agency’s services.
  • DHA: Refers to the Department of Home Affairs, Government of Australia.
  • RMA: Registered Migration Agent, licensed under the Office of the Migration Agents Registration Authority (OMARA).

Parties to the Agreement

  1. EduWork Education Agency, ABN: 66 666 9940 325, operating under the laws of Australia.
  2. The Applicant, referred to as "the Applicant" or "Client".
  1. Scope of Services

The Agency provides a comprehensive support service to assist the Applicant in applying for study visas in Australia. This includes:

  • Initial consultation
  • Study counselling and education provider selection
  • Communication with education institutions
  • Facilitation of tuition payment (the Agency does not pay fees on behalf of the Applicant)
  • Assistance obtaining Confirmation of Enrolment (CoE)
  • Student visa guidance and documentation support
  • Assistance finding the best OSHC
  • Visa application assistance
  • Help with setting up an Australian bank account
  • Support in applying for a Tax File Number (TFN)

Additional services for dependents (e.g., partners or children) are available at an additional cost.

1.1. Services Not Included

The following services are not included unless separately arranged in writing:

  • Migration advice beyond student visa subclasses (e.g., PR, partner visas)
  • Legal representation
  • Document translation or certification
  • Job placement or employment guarantees
  • Support for dependents, unless specifically agreed upon
  1. Applicant Responsibilities

The Applicant agrees to:

  • Provide truthful and complete information
  • Notify the Agency of changes to personal or visa-related circumstances
  • Submit required documents on time
  • Comply with Australian laws and visa regulations
  • Cover all external costs, including tuition, OSHC, visa fees, etc.
  • Follow the terms of this Agreement and cooperate with the Agency’s processes
  1. Fees & Payment Terms
  • Main Applicant: Free
  • Visa/Enrolment Support for Additional Family Members: $400 AUD per dependent (due before visa lodgement)
  • Administrative Fee (if visa application is withdrawn by Applicant): $400 AUD, non-refundable
  • Administrative Fee (if visa is denied for reasons not attributable to the Agency): $400 AUD, non-refundable
  • Fee (if visa is denied due to false or misleading documents from the Applicant): $1000 AUD, non-refundable
  • Tuition fee refunds: Follow the education provider’s official refund policy
  • Note: Any applicable fees are non-refundable once services have commenced
  1. Cancellations & Modifications
  • In the event of visa denial, the Agency retains administrative fees per Section 3
  • If false or misleading information is provided, the Applicant assumes full liability
  • Modifications to this Agreement must be in writing and signed by both parties
  • If the Applicant withdraws after CoE issuance or visa lodgement, admin fees apply
  1. Legal Compliance

The Applicant must follow all Australian immigration and education regulations. The Agency abides by the Education Services for Overseas Students (ESOS) Act 2000 and the National Code 2018, and is not authorised to give advice outside of student visa subclasses.

  1. Privacy and Information Sharing

The Agency complies with the Privacy Act 1988 and commits to the following:

  • Collection: Only essential data will be collected
  • Use: Data will be used strictly for providing agreed services
  • Disclosure: Data may be shared with DHA, education providers, OSHC providers, and TPS as necessary
  • Security: Reasonable steps will be taken to protect Applicant data
  • Access: Applicants may request access to their own information
  • Third-party Info Requests: No data will be shared with third parties (e.g., parents) without written consent if the Applicant is over 18
  • In emergencies, medical authorities may communicate with next of kin, and the Agency will assist accordingly
  1. Complaints and Dispute Resolution
  • Internal Resolution: Complaints should be emailed to [Insert Contact Email]. The Agency will acknowledge within 2 business days and respond within 10 business days
  • External Resolution: If unresolved, the Applicant may contact the Overseas Students Ombudsman or the relevant State/Territory Ombudsman
  1. Limitation of Liability

The Agency is not liable for:

  • Visa refusals or delays
  • Changes in immigration policy
  • Mistakes arising from incomplete or false documentation provided by the Applicant
    Liability is limited to the amount paid by the Applicant under this Agreement.
  1. Governing Law

This Agreement is governed by the laws of the State of New South Wales and the Commonwealth of Australia.

  1. Duration & Termination
  • This Agreement takes effect upon signing and remains valid until services are completed or the principal course visa outcome is determined
  • Either party may terminate the Agreement with 7 days’ written notice
  • Upon termination, any non-refundable fees incurred per Section 3 will be retained by the Agency
  1. Electronic Acceptance

By ticking the box "I have read and accept the terms of the EduWork Service Agreement" and submitting this form, the Applicant confirms they have read, understood, and agreed to all terms and conditions set out in this Agreement. This electronic action is considered legally binding and holds the same legal effect as a handwritten signature under Australian law.
